1. Introduction

Welcome to OMA TECH SOLUTIONS. By accessing our website or using our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided

OMA TECH SOLUTIONS provides software development, IT consulting, digital solutions including but not limited to:

• School, College & University Management Systems
• Hospital, Clinic, Pharmacy & Laboratory Management
• ERP, Accounting, POS & Inventory Systems
• E-Commerce Platforms & CRM Solutions
• HRMS, Payroll & Attendance Systems
• Custom Software Development
• IT Support & Maintenance Services

3. Intellectual Property Rights

Unless otherwise agreed in writing:

• The source code, design, and documentation of custom-developed software remain the intellectual property of OMA TECH SOLUTIONS until full payment is received.
• After full payment, the client receives full ownership of the custom-developed software.
• Our pre-built software modules, frameworks, and libraries remain our intellectual property.
• Clients may not resell, distribute, or sublicense our software without written permission.

4. Payment Terms

• Payment terms are agreed upon before the start of any project or service.
• All payments are to be made in Indian Rupees (INR) unless otherwise agreed.
• Late payments may result in suspension of services and/or legal action.
• All applicable taxes (GST, etc.) will be charged as per government regulations.

5. Delivery & Timeline

• Project timelines are estimated and communicated before commencement.
• Delays may occur due to unforeseen circumstances; we will notify clients promptly.
• Client delays in providing required inputs may extend the timeline.
• Milestone-based delivery schedules are followed for larger projects.

6. Confidentiality

OMA TECH SOLUTIONS respects the confidentiality of our clients. We will not share, disclose, or sell your business information, project details, or any confidential data to third parties without your explicit consent, except as required by law.

7. Warranty & Support

• We provide warranty for bug fixes and technical issues for a period specified in the project agreement.
• Warranty does not cover changes in requirements, third-party integrations, or modifications made by the client.
• Extended support and maintenance can be purchased separately.

8. Limitation of Liability

OMA TECH SOLUTIONS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from the use of our software or services.

9. Termination

Either party may terminate the agreement with written notice as per the terms agreed upon in the project contract. In case of termination by the client, payments for work completed shall be due and payable.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the jurisdiction of the courts in Murshidabad, West Bengal.

11. Changes to Terms

OMA TECH SOLUTIONS reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on this page. We encourage users to review this page periodically.
